6:00-9:00pm. Business people want to avoid commercial disputes for obvious reasons: disputes take time, cost money, tie up human resources, and may end a long lasting relationship. When negotiating contracts, parties are often reluctant to focus on the possibility that a dispute may arise between them. However, disputes do arise and, if they do, they require a process of formal dispute resolution. One of the most effective tools for dispute management is a well-drafted dispute resolution clause in the underlying contract. In the context of cross-border contracts, this usually, but not always, means an arbitration clause.
Baker & McKenzie's International Arbitration team will present on best practices in relation to key choices parties have to make when negotiating a dispute resolution clause in commercial cross-border contracts and provide most important legal updates in this area.
Speakers will also provide guidance as to which options may be most suitable for foreign companies doing business in the Asia-Pacific region in any given situation.
