The Hong Kong business community is deeply impacted by recent changes in the dynamic US-Hong Kong-China relationship. With the introduction of targeted US economic sanctions and export controls, and the revocation of Hong Kong's special status under some US laws, companies doing business or investing in Hong Kong face new risks and challenges unlike before.

Join the American Chamber of Commerce in Hong Kong for a special presentation featuring two former US government officials and experts in US sanctions and export controls, John Smith and Wendy Wysong, for a discussion of what these changes mean (and don't mean) for Hong Kong. Our speakers will aim to clarify common misunderstandings about US sanctions and export controls, highlight practical risks and impact and draw attention to key issues beneath the political rhetoric that warrant our attention. Their presentations will be followed by a Q&A period open to all attendees.

John E. Smith served as the Director of OFAC, as well as its Deputy Director and Associate Director, for 11 years before joining Morrison & Foerster in July 2018. Concurrent with serving as OFAC Director, Mr. Smith also served as acting Under Secretary for the Office of Terrorism and Financial Intelligence at Treasury (January 2017 to June 2017).

While serving as a top official at OFAC, Mr. Smith was centrally involved in all aspects of developing, implementing, and enforcing U.S. government sanctions requirements. As OFAC Director, he oversaw every OFAC enforcement case against financial institutions and global operating companies. Mr. Smith played a pivotal role as OFAC moved to the center of our nation’s response to the world’s most complex and challenging national security and foreign policy crises, working closely with other governments and multilateral agencies and the private sector. He has overseen the U.S. government’s economic sanctions efforts, imposing sanctions on heads of state, countries, and illicit actors; conducting enforcement actions against dozens of major financial institutions and companies around the world; and developing innovative sanctions enforcement policies to address evolving U.S. national security priorities.

Mr. Smith is now co-head of Morrison & Foerster’s National Security practice, and a member of the Global Risk + Crisis Management group and Investigations + White Collar group. Both in the United States and globally, clients turn to Mr. Smith for his deep experience and unique perspective on the complexities and escalating risk of U.S. and multilateral sanctions. He is a trusted advisor for clients navigating significant civil and criminal enforcement actions by U.S. and other government prosecutors and regulators. John was named by Global Investigations Review (GIR) in November 2019 as one of the most respected Washington, D.C. sanctions lawyers.

Jessica Bartlett is the Director of Financial Crime Legal – APAC at Barclays and is based in Hong Kong. Jessica advises compliance and legal teams and the business lines across the APAC region on financial crime issues including economic sanctions, export controls, anti-money laundering, fraud, and anti-corruption. Jessica joined Barclays at the beginning of 2018, and previously was a senior associate at Freshfields Bruckhaus Deringer based in Hong Kong for three years and focused on providing advice on financial crime issues arising in internal and regulatory investigations, transaction due diligence, contract negotiations and Hong Kong High Court litigation.

Before relocating to Hong Kong in early 2015, Jessica was an associate at Freshfields and Shearman & Sterling based in New York City. Prior to joining private practice, Jessica clerked for the Honorable Sidney H. Stein, District Judge for the Southern District of New York. Jessica graduated summa cum laude with a Juris Doctor from the University of Illinois. She also holds a Master of Arts in Philosophy from Brandeis University, and Bachelors of Arts degrees in Art History and Political Science from Southern Methodist University. Jessica is also a co-chair of the Law Committee for the American Chamber of Commerce Hong Kong.
