Dialogue with Jindrich Kloub – The Competition Ordinance’s fifth anniversary (Webinar)

AmCham is pleased to host Jindrich Kloub, the Executive Director (Operations) of the Hong Kong Competition Commission ("Commission") to share his thoughts at the occasion of the fifth anniversary of the Competition Ordinance.

Since the Ordinance came into force, the Commission has launched multiple educational campaigns, developed detailed guidelines and a comprehensive leniency policy, initiated (and won) prosecution against cartel arrangements before the Competition Tribunal, and issued a series of decisions and block exemptions.

Mr. Kloub will reflect on the main achievements of the past years and share his views on the areas of focus for the Commission in the next 5 years.

Following his presentation, there will be a fireside chat moderated by Sébastien Evrard for a more in-depth discussion with Mr. Kloub.

Mr. Jindrich Kloub was appointed to the position of Executive Director (Operations) of the Competition Commission (Commission) in October 2017.

Prior to joining the Commission, Mr. Kloub was an official at Directorate-General for Competition (DG Competition) of the European Commission from 2006 until 2017, dealing primarily with cartel enforcement and related policies. Mr. Kloub has vast experience with investigations across a variety of industries and was involved in some of the most prominent cases in the global financial sector in recent years. Prior to joining DG Competition, Mr. Kloub was in private practice, dealing with litigation and corporate work.

Mr. Kloub obtained his law degree at the Charles University in Prague and received an LL.M. from Columbia University in New York, where he was a Harlan Fiske Stone Scholar. He is a frequent speaker and author of articles on competition law and has taught university courses on EU competition law in Belgium and France.

Sébastien Evrard is a partner in the Hong Kong office of Gibson, Dunn & Crutcher LLP. He is a member of the firm’s Antitrust and Competition Practice Group. Based in Asia since 2010, Mr. Evrard handles complex antitrust matters in Asia and the European Union, including merger control, non-merger investigations, and litigation. His practice also focuses on the antitrust aspects of intellectual property rights.

Prior to joining Gibson Dunn, Mr. Evrard practiced in Brussels and Beijing with a leading international law firm. He previously had developed experience with all aspects of intellectual property (copyright, trademarks, patents, databases) and information technology (computer law, computer crime, privacy, and e-commerce).

Mr. Evrard is recognized as an expert in his field by publications such as Chambers & Partners. Most recently, Chambers Asia Pacific 2020 ranked him as a leading lawyer in China for competition and antitrust work. Mr. Evrard is also considered one of the leading competition lawyers in Greater China by Who’s Who Legal and by IFLR1000. He is a co-author of Anti-Monopoly Law and Practice (Oxford University Press, 2011), the leading English treatise on competition law in China, and Competition Law in China: Laws, Regulations, and Cases (Oxford University Press, 2014.

Mr. Evrard gained his LL.M. from Columbia University (James Kent Scholar (highest honor) and Walther Gelhorn Prize (valedictorian) in 2003, and his Licentiaat in de Rechten from the Catholic University Leuven in 1995. He is admitted to practice in Brussels and is a solicitor of the High Court of Hong Kong.
