Early this year, Financial Action Task Force (FATF) updated their recommendation for International Standards on Combating Money Laundering and the Financing of Terrorism & Proliferation. Hong Kong SAR, a member of FATF, is obliged to comply with the new standards.

As a result, The Financial Services and the Treasury Bureau published the Consultations Conclusion on Legislative Proposals to Enhance Anti-Money Laundering and Counter-Terrorist Financing Regulation in Hong Kong in April. It extended the statutory customer due diligence (CDD) and record-keeping requirements currently imposed to financial institutions to DNFBPs which impacts lawyers, accountants and company secretaries.

During the session, Michael Lintern-Smith from The Law Society will share “Latest Regulation Update and Extension of Customer Due Diligence Requirements to Non-Financial Businesses in Hong Kong”. Then join by industry experts from EY, The Hong Kong Institute of Chartered Secretaries, Thomson Reuters and Tricor Group to discuss impacts to DNFBPs and industry best practices to comply with the standards.

Michael Lintern-Smith has practised as a lawyer in Hong Kong since 1982. He was made a Partner of Robertsons in January 1985 and has been the firm’s Senior Partner since 1989. Mr. Lintern-Smith was the President of The Law Society of Hong Kong in 2004-05 and is a current Council Member of the Society.

He is the Chairman of Anti-Money Laundering Committee of the Law Society of Hong Kong. He is also a member of the Inter-Pacific Bar Association, Lawasia, the Commonwealth Lawyers Association, the French Chamber of Commerce and the Hong Kong Institute of Directors. He is a former Chairman of the European Committee of Hong Kong General Chamber of Commerce and a current Chairman of the Buildings Ordinance Appeal Tribunal Panel. He is the clerk of the Disciplinary Committee of the Hong Kong Confederation of Insurance Brokers.

His area of practice is in advising multi-national corporations on structuring and business regulation in Asia.

Mohan has been in leadership roles in running businesses, strategising, marketing and brand building. He built a start-up law firm in Hong Kong from 8 lawyers to 120 lawyers over a 10-year period; then merged it into a US international law firm where he stayed on as partner. He then took on the challenge as senior management of a listed company and helped built it into a frontier mining company and MSCI Hong Kong index constituent, and thereafter became Chief Business Strategist of a listed securities company.

Mohan is now Senior Director and Head of Technical and Research at The Hong Kong Institute of Chartered Secretaries and promotes good governance. He also serves the public through various Government board appointments, and has co-authored ‘Competition Law in Hong Kong’.

He is a Certified Public Accountant, Chartered Secretary and graduate of King’s College London.

A seasoned professional in the financial services industry, Paul is a contributor to a number of publications and a regular speaker on topics ranging from licensing under the Securities and Futures Ordinance to corporate governance and anti-money laundering. Paul served as a Council of the Hong Kong Institute of Chartered Secretaries and was Chairman of the Institute’s Professional Services Panel. He has also served on a working group for the Companies Ordinance Rewrite.

Ajay Shamdasani is a senior regulation correspondent with Thomson Reuters Regulatory Intelligence in Hong Kong.

His focus is on financial crime, money laundering, tax evasion, fraud, corruption, data privacy and cybercrime. He was previously editor-in-chief of "Macau Business" magazine and deputy editor of "A Plus" magazine - the journal of the Hong Kong Institute of Certified Public Accountants.

He attained an AB in history and political science from Ripon College in Ripon, as well as Wisconsin, JD and MIPCT degrees from the University of New Hampshire School of Law (formerly Franklin Pierce Law Center) in Concord, New Hampshire. He also holds an LLM in financial regulation from the Illinois Institute of Technology's Chicago-Kent College of Law.
