Event Details

In early October 2022, the US Department of Commerce's Bureau of Industry and Security (BIS) released a rule amending the Export Administration Regulations (EAR) to address US national security and foreign policy concerns. These changes include controls on advanced computing integrated circuits (ICs), computer commodities that contain such ICs, and certain semiconductor manufacturing items. They also include expanded controls on transactions involving items for supercomputer and semiconductor manufacturing end uses and the scope of foreign-produced items subject to license requirements for twenty-eight existing entities on the Entity List that are located in China.


Our AmCham panel guests include James Andrew Lewis, the Senior Vice President and Director, Strategic Technologies Program at CSIS and Akin Gump's International Trade Practice Partners Tatman Savio and Kevin Wolf, who was the former Assistant Secretary of Commerce for Export Administration of BIS in the Obama administration. They will discuss these changes to EAR and the controls which will restrict the PRC's ability to obtain advanced computing chips, develop and maintain supercomputers, and manufacture advanced semiconductors and look at the traditional controls on the export of listed commodities, software, and technology as well as the novel controls on:


  • activities of US corporations and individual US citizens;
  • exports of unlisted items for specific end uses; and
  • shipments from outside the US (including from China) of non-US-origin items produced with specific types of US technology, software, or equipment.


This webinar will assist US and non-US companies (and individual US citizens) that engage in transactions pertaining to the advanced computing, artificial intelligence, supercomputer, semiconductor production equipment, or semiconductor-related supply chains involving China with an understanding of the complex rules and help them determine whether their internal compliance programs and business plans need to change.
